Estate Planning Attorney Serving Houston

Assisting Clients with Probate and Elder Law in Harris County

Representing families is not always a matter of responding to changes and resolving disputes.  It also involves planning and making arrangements for the future, or taking care of elderly relatives.   The Law Office of Maria Lowry in Houston, Texas provides clients with services ranging from the preparation of simple wills and guardianships to handling the probate process.

Planning Documents

When providing planning services, we make every effort to understand our clients’ interests and goals, and provide each client with the information and resources to ensure that their wishes are carried out appropriately and that property and assets are distributed according to their wishes after death.  Our office assists clients in preparing the following planning documents:

  • Wills & Trusts – A will tells a person’s family and the courts how a person’s property is to be distributed upon his or her death.  It is the most straightforward way to ensure your assets are distributed according to your wishes and your family is taken care of after you are gone.  Some people also use trusts in conjunction with a will.
  • Powers of Attorney – A power of attorney is a legal document in which a person designates and authorizes another person to transact business or make certain decisions on his or her behalf. It may also grant another person the authority to make medical decisions and end-of-life decisions.
  • Advance Directives – An advance directive is a legal document that specifies what actions should be taken, if any, for a person’s health if he or she is no longer able to make decisions due to illness or incapacity.
  • A comprehensive plan may include any or all of these documents depending on a client’s particular needs and priorities.

Guardianship

When a relative is not able to make decisions and manage his or her affairs, and does not have a power of attorney designating someone to do these things, a guardianship becomes necessary.  The Court appoints a person to serve as guardian on a temporary or permanent basis, depending on the circumstances of your family.  Contact us for advice and assistance in obtaining a guardianship.

Probate

Probate is the legal process by which a person’s final debts are settled and the title to assets and property is formally passed to beneficiaries and heirs.   This is the case whether there is a will or not.  At the Law Office of Maria Lowry, we guide clients through the probate process, always working to ensure matters are handled as swiftly and smoothly as possible.
